排污许可证制度的实践与价值分析

Abstract:The discharge permit is an administrative permit set up by the government for stationary sources and point sources management. Therefore，the discharge right is a privileged right under the permit，not a general right，and certainly not a property right. The permit covers all the specific requirements of environmental laws and regulations on the enterprise. It is the enforcement document issued by authorized agency for supervision，and a contract to polluters in which the detail provisions on pollution control is stated clearly. The enterprise have to provide the compliance evidences based on the requirements of the discharge permit，and the government should verify the evidences in accordance with the laws. Stationary source discharge permit includes measures for area source management，and the requirements of local air quality plan. Point source discharge permit is the key instrument to ensure surface water quality standards. It’s necessary to develop water quality-based effluent limitations in point source discharge permit，includes non-point source management measures within the area of points source plant. As a conventional management means for stationary sources and point sources，discharge permit must be implemented and managed based on the laws and regulations professionally.
