论侨乡文化保护的法治化问题

Abstract:Qiaoxiang culture is the spiritual bond connection between overseas Chinese and hometown. Systematic protection of qiaoxiang culture can stimulate enthusiasm of overseas Chinese to participate in China's modernization construction. Currently，the protection of qiaoxiang culture still have many problems as lack of legal value，lack of scientific protection system，lack of ecological protection awareness and etc，which are detrimental to qiaoxiang culture protection systematically and dynamically. Considering that qiaoxiang culture protection has legal attributes as combination with public welfare and private right，guarantee of human rights and overseas Chinese affairs，the access for legal protection of qiaoxiang culture should be in accordance with overseas Chinese affairs legalization's basic requirements，research，design and establishment of new system for qiaoxiang culture protection，which be able to reflect social reality，fulfill inherent requirements，comply with principle and be in compliance with China's Constitution and other laws.
