2014年美国反垄断与知识产权政策述评

Abstract:This article reviews and analyzes the important developments of the U.S. federal antitrust policy and antitrust scrutiny of intellectual property rights from fiscal year 2014 to early 2015，in particular，the investigation into the car parts cartels，the new guiding principles on the SEP and the FRAND published by the Antitrust Division of the Department of Justice，and the enforcement attitude of the Federal Trade Commission to the reverse payment agreements in the pharmaceutical industry. The article predicts that the U.S. Department of Justice and the Federal Trade Commission will continue rigorous antitrust enforcement，strictly panelize cartels，rectify other restrictive conducts，reinforce competition advocacy activities，and seek balance among the objectives of protecting intellectual property rights，encouraging innovation，and ensuring effective competition.
