Abstract:This Report estimates the binding force of 47 maritime treaties signed between China and ASEAN countries by establishing a relatively complete evaluation system of binding force of treaties and quantitative analysis of treaty texts. It is concluded that the binding force of bilateral treaties is higher than that of multilateral treaties among the maritime treaties signed by China and ASEAN countries，and the binding force of treaties are different in countries. In terms of the binding force of maritime multilateral treaties，the Philippines scores highest，while Singapore is the lowest. In bilateral maritime treaties，Thailand is the highest and Cambodia is the lowest；In bilateral maritime agreements，the treaty binding force of Thailand and Vietnam is the highest，while the treaty binding force of Singapore and Malaysia is low. At present，the annual change of the average binding force of multilateral and bilateral maritime treaties signed by China and ASEAN countries is in a steady and slightly decreasing trend. Therefore，China and ASEAN countries should actively promote the formulation of bilateral and multilateral maritime cooperation treaties to create a good institutional guarantee and legal environment for the regional maritime cooperation.
