个人信息安全的刑法保护研究

Abstract:This paper carried out a research on the personal information security issues. By counting all the personal information protection related criminal cases published by China Judgments Online since 2013，this paper separately counts the time changes and spatial distribution of such cases. At the same time，this paper also counted whether the identity of the person involved is special，what crime the person involved is convicted，how long is he or she was sentenced and how many personal information was involved in these cases descriptively，the co-relationship is also analyzed. It also analyzed the relationship between the three terms of “penalty period”，“the amount of money involved” and “the amount of personal information involved”，in order to make a perspective on the protection tendency and intensity of personal information in the criminal law presented in the trial case. The paper found that the cases involved in the trial are mostly ordinary people，the crimes are single，the sentence is not long，but the amount of personal information involved is huge. The data in this paper also proved the inference that the “personal information is extremely cheap” proposed by the researchers.
