法治指数量化评估中的实践与反思

Abstract:With legal discourse power having been widely accepted，it became a highly valued subject to learn to judge the level of legal development by using index evaluation method and to boost the development by neutralizing technological modes.Currently，rule of law index is of unique significance in China that using practice of quantization method to promote the development of law has gradually become an important means in local legal practice throughout the country.Quantization of rule of law will be helpful for the government and court to look for gaps on account of existing standards of the rule of law and thus to find out the acting point of the construction of society rude by law.The Index of Government under the Rule of Law，as well as the Index of Judicial Fairness，is an important type of evaluating index in the Quantization of the rule of law.China’s practice，based on the gime of two kinds of above-mentioned indexes，reflects the feature of isostructuralism.To set up seientific and reasonable quantitative assessment system of local rule of law，problems in the following four aspects should be solved：1.The harmonization between the theoretical research on rule of law and the establishment of assessment index；2.The neutrality of assessment of local rule of law；3.The reasonableness of the establishment of index contents；4.The organic integration of quantitative methods and qualitative methods.
