新《土地法》实施的争议及其解决建议

Abstract:The core controversial issue arose since the implementation of New“Land Law”mainly related to the imperfect of its provisional concession regime of lapse which the current law is not able to provide reasonable and proper method to solve the issue of the lapse of the provisional concession of land after the expiration of its term.Meanwhile，it also emphasizes the loophole of the law legal regime per se.The problem of a legal regime is a kind of political issue in nature which cannot be handled by recourse to law court，it must be solved by means of executive-led lawmaking under the framework of the political structure of Macau SAR.The author suggests two lawmaking approaches，promulgation of a special land ordinance and amendment of the current law land，respectively to solve the issue of the lapse of concession of “idle land” punctually and effectively as well as to comprehensively perfect the insufficiency of the New “Land Law” at the same time.
