中国防治海洋外来物种入侵立法模式探析

Abstract:Legislative mode includes the target mode based on legislative intrinsic values and external structural style pattern on the body of law mode. Defects on legislative mode of marine invasive species result in its inappropriate legislative purpose and fragmentation of the legal response. From the foreign legislation perspective，comparison about Germany and the U.S. in the legislative mode selection implementation provides a reference for China’s legislation mode selection；meanwhile，combined with the relevant domestic legislative status analysis together，the paper comes to the conclusion that legislative mode of marine invasive species should apply for sustainable developmental target mode and special legislative body of law mode.
