文章摘要：在当今的刑法学研究中使用经济分析方法，已经屡见不鲜。本文在考察刑法学的经济分析的内涵、地位，并阐明其基本主题、目标与理论预设的基础上，先后研究了经济分析方法在刑法哲学、刑法教义学、刑事政策学和刑事诉讼法学中的运用，最后提出了四项已经得到证实的结论和两项悬而未决的争议，以期抛砖引玉，唤起刑法学学术共同体对此问题的关注。
