算法治理与平台责任初探

Abstract:This paper introduces the governance trends of algorithms in China，EU，and the US，and analyzes the algorithmic responsibilities of the platform，as well as the characteristics and existing problems of current algorithmic governance. In combination with the “Regulations on the Administration of Internet Information Service Algorithms Recommendation” and other algorithm-related legislation. This paper believes that the current algorithmic governance mechanism has fully considered the impact and risks that the public nature of the platform may bring to the society，but it lacks consideration of the platform’s identity as a market subject. The problem-oriented scenario-based governance of algorithms is only an expedient measure in response to the development of algorithms，and cannot cope with the continuous emergence of new applications and new formats brought about by the rapid development of the Internet. Legislation on algorithms in the future should go beyond the governance model based only on scenarios，and a normative and systematic governance mechanism based on the adjustment of legal relations is needed，and the development of algorithms as well as security should be taken into account.
