个人信息保护关键监管环节及监管策略研究

Abstract:With the information technology revolution especially big data applications，global society entered a “data driven” era. However，the big trend of data applications has brought unprecedented challenges to personal information protection and civil rights. Ubiquitous data collection technology and specialization of diverse data processing technology make it difficult to control the collection and application situation，which weakens the the self-determination right to personal information of the information subject. Meanwhile the sharing resources，opening up demands of big data has the natural contradiction with personal privacy protection. To pursuit maximizing value，the misuse of personal information is almost inevitable. This article analysis the personal information protection regulation，regulatory object，management functions，management mechanism of the United States，the European Union，Australia，Russia，Singapore. The preliminary judgment of China’s personal information protection regulation current situation and international level has been carried out. Possible countermeasures from the scope of organization，rules and regulations，supervision mechanism，security conditions of personal information protection supervision system have been put forward in this article.
