Abstract:There is a wide space for the application of the right to be forgotten in criminal justice：all participants in criminal proceedings，including convicted criminals，victims of crime，acquitted criminal defendants，and witnesses，have an interest in claiming the right to be forgotten. However，the right to be forgotten claimed by these subjects of information in criminal justice may conflict with such rights and legal interests as the right of the public to know，the freedom of speech，the freedom of the press，and the interest of public security. To solve these conflicts，it is necessary to impose restrictions on the right to be forgotten with respect to the scope of right subjects，types of applicable cases，and the method and procedure of exercise of the right，so as to realize the reasonable operation of this right in the field of criminal justice.
