Abstract:Currently，global trade and investment is threatened by the challenges of national protectionism，such as illegitimate export control，strict corporate identities regime，fragmentation of international mechanisms，and increasing geopolitical risks. More specifically，China’s high-tech enterprises shall deal with the legal risks by the directional national security review，international human rights regulations，the unclear legal rules and the unilateral sanctions. Without doubts，the legal rules function a critical role in overseas investment. Therefore，China should strategically strength the sovereignty in domestic legislation and law enforcement，effectively use the converging function of regional and bilateral economic and trade agreements，and continuously encourage enterprises to raise the awareness of the rule of law.
