Abstract:Africa is not only an important node of “the Belt and Road”，but also an important direction and goal of advancing it.South Africa who has returned to the biggest economy in Africa will play an important role of guide in the China-Africa trade.Under the Comprehensive Strategic Cooperative Partnership and BRICS Mechanism，Chinese enterprises will get great opportunities to invest in South Africa.But due to the particularity of the environmental and mineral resources laws in South Africa，Chinese enterprises are confronted with strictly legal environment，which will result in loss.Therefore，Chinese investors should learn more about local laws，including the environmental legal restraints and their impacts on investment interests，particularly the procedures and fees of application，transfer，mortgage for mining right.Moreover，they must fulfill its obligations to tailings pond，slag storehouse and mine closed effectively，obey the procedures of environmental assessment and repair，to shoulder the social responsibility to protect the ecological environment in Africa actively. Lastly，they have to strengthen the protection of Historically Disadvantaged South Africans（HDSAs）and Community rights.
