全球数据跨境流动监管机制及中国路径

Abstract:The acceleration of cross-border data flow has had a significant impact on the international trade order，the protection of user information，and national jurisdiction. A review of global practice of regulation of cross-border data flow shows that main countries and regions in the world have constructed the mechanism for the regulation of cross-border data flow by taking the orderly free flow of data as the rule，and classified regulation of special data as the exception. As for the Chinese mechanism for the regulation of cross-border data flow，the author suggests that the government should adopt high-level law in this field and actively participate in the creation and implementation of an international cooperative mechanism for the regulation of cross-border data flow.
