数权制度体系与国际比较研究
文章摘要:当前,全球已有140余个国家或国际组织制定了隐私、信息或数据保护方面的法律法规。美国将数据保护纳入隐私权之中,欧盟和德国从数据权利的角度赋予数据法律属性,日本则较好地吸纳了各大法系中数据制度的优点,而我国《网络安全法》以及即将出台的《数据安全法》《个人信息保护法》构筑了数据领域的基础性法律。本报告在比较国内外数权制度的基础上,对数权制度体系之于互联网全球治理的意义进行了阐释,旨在推动互联网全球治理朝着系统化和法治化方向迈进。
Abstract:At present,more than 140 countries or international organizations around the world have formulated laws and regulations on privacy,information or data protection. The United States includes data protection in privacy rights,EU and Germany endow data with legal attributes from the perspective of data rights,Japan draws on the advantages of data systems in major legal systems,and China constitutes the basic laws in the data sector with the Cyber Security Law,as well as the upcoming Data Security Law and Personal Information Protection Law. This paper elaborates on the significance of the data rights system to global Internet governance on the basis of comparing domestic and foreign data rights systems,with an aim to foster more systematic and law-based global Internet governance.
