跨境电商知识产权保护国际规则研究及对我国的启示

Abstract:Illegal infringement of intellectual property rights is one of the barrier of China’s cross-border e-commerce enterprises going overseas. The intellectual property rights protection of cross-border e-commerce can improve the commodity premium and help enterprises get out of the low quality competition. Cross-border E-commerce intellectual property rights promote the transaction of digital businesses such as music，video，film，literature，software systems，and so forth. At present，the formulation of laws and regulations in China’s cross-border e-commerce intellectual property rights is lagging behind，and there is no special regulatory authority for cross-border e-commerce intellectual property rights. In addition，the punishment for illegal infringement is relatively light. A part of small and medium cross-border e-commerce enterprises don’t fully understand the intellectual property rights laws and regulations of the sales destination countries，and failure to prevent the potential infringement risks of intellectual property rights. Therefore，China should improve the legal and regulatory system，establishing a multi-party cooperation mechanism，widening channels of rights protection and assistance，building the public information platform，strengthening international cooperation and talent training.
