数据出境流动安全管理规范研究

Abstract:In recent years，with the implementation of strategic such as “the belt and the road” and Chinese enterprises “going global”，Electronic commerce，cloud data centers and other outbound services are becoming increasingly frequent，therefore，the resulting personal information and industry data outbound have dramatically increased. Data Outbound flow is conducive to the promotion of national information technology innovation and the development of the digital economy industry，but also associated with the national security，industrial security and personal privacy rights and other issues. In February 2017，the US court ordered Google to submit mail servers stored outside the United States，making the data outbound management become a focus again. In April 11，2017，the Cyberspace Administration of China issued the “measures of personal information and important data outbound security assessment （Public solicitation draft）” to implement the thirty-seventh provision of the “Cyber security law”，and establish the data outbound security assessment management system. On the basis of summarizing the foreign data outbound management experience，this paper puts forward the basic understanding and judgment of the concept of outbound data in the view of national management，and provides some suggestions according to the current situation and problems of China’s data outbound management.
