“私权力”崛起背景下的网络安全机制再思考

Abstract:Mastering internet technologies and massive data，network operators not only become a pivotal “private power” in cyberspace，but also change the structure of social power in reality. This paper analyzes how “private rights” come into being，what is the core mission of network security system in the context of “private rights” and the issues should be noted. Based on the analysis of the three major issues need to be resolved in cyber legislation，this paper discusses the problems of current internet regulatory approach，and points out that the cyber security system should fully explore the function of knowledge（technology）as regulatory resource，and coordinate the relationship between “public” and “private” powers，so as to promote the security，development and freedom of cyberspace.
