欧盟GDPR监管模式对我国个人数据治理的启示

Abstract:General Data Protection Regulation（GDPR）came into force on 25th May 2018，covering 11 chapters and 99 articles，being regarded as the most strict data protection law in history. The legislation is the landmark in the field of personal information. GDPR has made relatively excellent provisions on the protection of individual numbers，covering the scopes of application，rights of data，fulfillment of obligations，transmission of data，punishment，supervision and other measures，which are worthy of depth thinking and researching. With the rapid development of Internet industry，the absence of law，personal data abuse and insufficient data protection and other problems in China’s personal data governance needs to be solved. Personal datalegislations and GDPR defined the scope of sensitive information，includes data subject rights，cross-border transmission and execution and implementation effects. Based on these differences，we need to combine innovative contents and domestic practices of GDPR，in the concept of learning advanced GDPR personal data protection practices and we should also focus on national conditions to prevent the impacts and challenges of the GDPR，and then establish and improve the mechanism of the personal information protection，promoting personal data governance.
