长三角地区生态补偿法律调控——以太浦河为例

Abstract:As an important transboundary river in the Yangtze River Delta region，the Taipu River is of great significance to the development of ecological green integration in the Yangtze River Delta. Ecological compensation legal regulation can effectively ensure the reasonable allocation of environmental justice in the Taipu River Basin，the fair distribution of scarce benefits，and the effective realization of incentive functions. The legal system of ecological compensation in the Yangtze River Delta region is scattered in the Constitution，environmental protection related laws，administrative regulations and local regulations. There are still obvious deficiencies in ecological compensation standards，compensation methods，and legal liability. The ecological compensation practices in the Yangtze River Delta mainly include water quality trading，off-site development，water rights trading，and emissions trading，but they also face many legal difficulties. In general，the legislation and practice of ecological compensation in the Yangtze River Delta mainly have the problems of insufficient legal governance，reliance on policy drivers，and lack of property rights，making it difficult to identify the compensation subject. Therefore，the legal regulation of ecological compensation in the Taipu River Basin in the Yangtze River Delta region should start with clarifying the subject of rights and obligations of ecological compensation，legal standards of ecological compensation，legal methods of ecological compensation，ecological compensation management institutions，legal compensation of ecological compensation property rights，and dispute resolution mechanisms.
